In-state tuition in Georgia, by visa
Whether a family on a work visa can ever pay the resident rate in Georgia — the
governing rule, the H-4 and F-1 answers, the waiting clock, and any high-school-attendance path.
The residency officer is always the final authority; this page gets you to the right one with the
right citation.
H-4 child of a domiciled H-1B parent No — by published rule
In-state classification requires citizen/LPR/Title-IV-eligible noncitizen — nonimmigrant visa holders cannot be classified in-state at all. Workaround: the Economic Advantage out-of-state tuition differential waiver for employment-visa holders (and per Georgia Tech's catalog their dependents) who relocated for full-time work and show steps toward LPR — grants the in-state RATE, not the classification.

Who decides
Statewide: USG BOR Policy 4.3.2/4.3.4 (lawful presence); institution applies.
The high-school path
None — None; lawful-presence verification (since 2011) bars undocumented students from in-state rates..
Where this comes from
USG BOR Policy Manual §4.3.2, §4.3.4; O.C.G.A. §20-3-66.
Re-verification note: Dependent waiver wording differs between campuses (new grant vs continuation-only) — confirm per campus before advising.
