H-4 EAD & Spouse Restart

A spouse in H-4 status may apply for employment authorization under category (c)(26) if the H-1B principal spouse is the beneficiary of an approved Form I-140 immigrant petition, or has been granted H-1B status under sections 106(a) and (b) of AC21 (the provisions that let an H-1B extend past the normal six-year limit because a green-card process is already underway). An H-4 spouse whose principal has neither does not qualify under this category.

DHS published an interim final rule effective 30 October 2025 that ends automatic extension of employment authorization for most EAD renewal filings made on or after that date — including H-4 dependent spouses. Before this rule, a timely-filed renewal could carry an automatic extension of up to 540 days while the new card was pending. For a renewal filed on or after 30 October 2025, there is no automatic extension at all: work authorization simply expires the day after the current EAD's printed expiration date, and does not resume until the renewal is actually approved, unless a separate legal basis to work exists in the meantime. A renewal filed BEFORE 30 October 2025 is not affected by this change and keeps whatever automatic-extension terms applied when it was filed.

USCIS permits filing Form I-765 to renew an EAD up to 180 days before the current card's expiration date. This is a filing WINDOW — when you are allowed to submit the application — and is a completely separate figure from the automatic-extension LENGTH the rule above just removed. Conflating the two is exactly the mistake this page exists to prevent: reading 'up to 540 days' somewhere and assuming it describes how early you may file, or reading 'up to 180 days' somewhere and assuming it still describes an automatic extension, both land on a wrong and dangerous conclusion about whether you may currently work.

H-4 status, and therefore eligibility to hold a C26 EAD, is derivative of the H-1B principal spouse's own status remaining valid. If the principal's H-1B is not itself timely extended, the dependent H-4 status — and the EAD built on it — does not survive independently. This is a distinct risk from the EAD renewal-timing question above and moves on its own schedule: tracking the EAD deadline while missing a lapse on the principal's side solves the wrong problem.
