What a Landlord May and May Not Ask

Arriving without an American credit file or an American guarantor is a real disadvantage, and most of the advice about it is folklore. National origin is protected — a refusal to rent because of where you are from is unlawful verified

It is unlawful to refuse to sell or rent, to refuse to negotiate for a rental, or otherwise to make a dwelling unavailable to any person because of race, colour, religion, sex, familial status or NATIONAL ORIGIN. Where you were born and where your family is from sit squarely inside that list. A leasing office is entitled to assess whether you can pay; it is not entitled to decline you for being foreign.

The protection covers the TERMS too — not just the yes or no verified

It is separately unlawful to discriminate against any person in the terms, conditions or privileges of the sale or rental of a dwelling, or in the provision of services or facilities connected with it, on those same protected bases. This is the more useful half in practice: an application that is accepted, but only on a larger deposit, a shorter term or an extra guarantor imposed because of a protected characteristic, is reached by the statute just as a flat refusal would be.

And the listing itself — a notice indicating a preference or limitation is unlawful on its face verified

It is unlawful to make, print or publish any notice, statement or advertisement with respect to the sale or rental of a dwelling that indicates any preference, limitation or discrimination based on the protected characteristics. A listing that states a preference on one of those bases is a violation in the advertisement itself, before anybody has applied or been turned down.

Immigration status is not on that list — which is exactly why the distinction matters verified

The characteristics the statute enumerates do not include immigration or visa status. Being asked to document your status, or to show a right to be in the country, is therefore not by itself unlawful under this provision — and a page that told you otherwise would set you up to lose an argument. The question that DOES engage the statute is different: whether a requirement is being applied only to applicants of a particular national origin, or applied in a way that operates as a proxy for it. That is a fact-specific assessment about how a landlord treats comparable applicants, and it belongs with a fair housing office or a housing lawyer rather than with a calculator.

There is a place to take it, and using it costs nothing verified

Enforcement of these provisions does not depend on hiring a lawyer first. Complaints of housing discrimination are received by the Department of Housing and Urban Development, and by state and local fair housing agencies, at no cost to the complainant. Deadlines apply to filing, so a complaint worth making is worth making early rather than after the search is over.
